STATEMENT OF PURPOSE
Been There, Inc. Disclosure Statement


As indicated in the Been There, Inc. Service Agreement, Been There, Inc, provides non-medical and in-home care for persons with disabilities and the elderly who require assistance with the Activities of Daily Living, (ADL’s). It is NOT within the scope of Been There, Inc. license to manage the medical and health conditions of its clients should be unstable or unpredictable.

Qualification and Training Requirement:

Personal care attendants employed by Been There, Inc. will have training in CPR, First Aid, health screening conducted in accordance with NAC 441A.375, criminal background checks conducted in accordance with NRS 449. Been There, Inc. PCA’s receive a copy of NAC 449 Provision Pertaining to Agencies providing Personal Care Services in the home.

Been There, Inc. personal care attendants receive training in the following topics: Orientation to Been There, Inc., Service Plan, Community and DHCFP, Medical Assistance Program Services, Health Oriented Record Keeping, Verification of Time Records, Duties and Responsibilities of PCA’s, Personal Care Services which are Permitted and NOT Permitted, Ethics, Elder Abuse, Infection Control and Universal Precautions, Changes Related to Aging, Safety and Accident Prevention, Recognizing Responding to Emergencies, Fall Prevention, Body Mechanics and Transfer Techniques, Food, Nutrition, and Meal Preparation, Hydration, Medication Reminders, Personal Care, Bathing and Grooming and Mobility Techniques, Bowel and Bladder Care, Skin Care, Recipient’s Rights, HIPPA, Advance Directives, Communication Skills, Communication with Alzheimer’s and Dementia Clients, Adverse Behavior, Care of the Home and Personal Belongings, Maintenance of Clean and Safe Environment. Special Needs of the Elderly (including training in sensory, physical and cognitive changes), Special Diets, Catheter and Colostomy care, Skin breakdown prevention techniques, preventing contractures and simple, non-prescribed range of motion.


Charges for Services and Billing:

Private pay clients will be charged and billed weekly as described in the Been There, Inc. Hourly or Live-In Service Agreement. Payment is due upon receipt of bills. Remittance can be mailed to Been There, Inc. 8760 S. Maryland Parkway, Suite 124, Las Vegas, Nevada, 89123. Clients should mail checks or money orders payable to Been There, Inc. and should NOT mail cash. Been There, Inc. charges $17.00 per hour for its Personal Care Services. Medicaid clients will be not be charged for services, and their services will be billed to the state of Nevada under the Personal Care Services program.

Termination of Services:

Been There, Inc. might terminate services for reasons that are not limited to but not include: severe deterioration of client’s health, unsafe environment, illegal activities by client’s, inability to remit payment. Been There, Inc. will give clients or family members adequate notice of its intention to terminate services.

Contacting Administrator:

Been There, Inc. representative are accessible by telephone 24 hours a day, 7 days a week at (702) 722-2675 or (702) 485-4902. The Been There, Inc. office is open Monday through Friday from 9:00 a.m. to 5:00 p.m. except on holidays, and a Been There, Inc. manager is on-call after hours and on weekends. Telephoning the Been There, Inc. number of record during business hours or after hours will allow the client to reach a Been There, Inc. manager. The manager can contact the administrator, who carries a cellular telephone with him, and request the administrator contact a client who wishes to speak with him.

Client Rights:

Client rights include, but are not limited to:

Speaking to any person who advocates for the rights of the client of the agency.
Receiving considerate and respectful care that recognizes the inherent worth and dignity of each client.
Participating in the development of the service plan and receiving an explanation of the personal care services pursuant an service plan and receiving a copy of the service plan.
Receiving the telephone of the Bureau of Licensure and Certification, which can be contacted for complaints. The telephone is (702) 486-6515.
Receiving notification of any authority of the Health Division to examine the records of the client as related to the regulation and evaluation of Been There, Inc. by the Health Division.
Receiving from Been There, Inc. within the limits set by the service plan established for the client and within the program criteria, responses to reasonable request for assistance.
Receiving information, upon request, concerning the policies and procedures of the agency, including, but without limitation, the policies and procedures of the agency relating to charges, reimbursements and determination concerning service plans.

Grievance Procedure:

Clients can report a grievance by telephone 24 hours a day, 7 days a week by calling Been There, Inc. Client grievance should be reported to Been There, Inc. representative who then report the grievance to the administrator or his designee. The administrator or his designee will have the grievance investigated in a timely manner. The client will be notified of the action taken in response to the grievance, or give a reason why no action needed to be taken in response.

If a personal care attendant fails to provide services in accordance with the service plan, the client should the above grievance procedure. Similarly, if a scheduled personal care attendant fails to show up for a scheduled visit/shift, the client should follow the above grievance procedure. If a client needs an additional visit/shift than what is normally scheduled, the client should telephone Been There, Inc. to request the additional service and every effort will be made to accommodate the date. All grievances will be investigated by the administrator within ten days. Been There, Inc. will supply all clients with a grievance form to be filled out regarding any grievances and incident reports.

Permitted Duties:

Personal care attendant duties include, but might not be limited to the following:

Assist with activities of daily living such as: dressing, bathing, grooming, eating, routine hair and skin care.
Assistance with toileting needs.
Assistance with transfer activities and ambulation.
The personal care assistants do NOT administer medication, but can provide medication reminders.
Assistance with meal preparation. Examples are meal preparation activities including menu planning, storing, preparing and serving food.
Assistance with housekeeping duties. Examples of housekeeping duties, include but not limited to changing bed linens, laundry, washing dishes, shopping, and LIGHT HOUSEKEEPING. Housekeeping tasks do NOT include basic homemaker services that maintain an entire household or family.
Grocery shopping and other errands.

Services Which Are NOT Permitted:

Services that are NOT within the scope of personal care attendants, include but are limited to:

Insertion or irrigation of catheters.
Irrigation of any body cavity, including without limitation, irrigation of the ear, insertion of an enema or a vaginal douche.
Application of dressing involving prescription medication of aseptic techniques, including, without limitation, the treatment of moderate or severe conditions of the skin.
Administration of injections of fluids into veins, muscles, or the skin.
Administration of medication, including, without limitation, the insertion of rectal suppositories, the application of prescribed lotions for the skin, or the administration of drops in the eyes.
Performing physical assessments.
Monitoring vital signs.
Using specialized feeding techniques.
Performing a digital rectal examination.
Trimming or cutting toenails.
Massage.
Providing specialized services to increase the range of motion of a client.
Providing medical case management, without limitation, accompanying a client to the office of a physician to provide medical information to the physician concerning the client to receive medical information from the physician concerning the client.
Any tasks identified in NRS chapter 632 and the regulations adopted by the State Board of Nursing, as requiring skilled nursing, including, without limitation, any services that are within that are without the scope and practice of a Certified Nursing Assistant.
Been There, Inc. will not supply clients with any transportation services.

Prohibited Activities:

In addition to the above not permitted services, personal care attendants are prohibited from:

Making personal long-distance telephone calls on a telephone owned or provided by the client, or while-on-duty providing personal care services to a client.
Loaning, borrowing or accepting gifts or money or personal items from a client.
Accepting or retaining money or gratuities from a client, other than money needed for the purchase of groceries or medication for the client.
Becoming the legal guardian of a client or being named as an attorney-in-fact in a power of attorney executed by the client.

Client’s Backup Plan:

Each client should develop a backup plan in case of his/her own caregiver cannot come in that day. Been There, Inc. will make every
effort to find a replacement caregiver. A backup caregiver will come in as soon as possible.

Missed Visits By A Caregiver:

If a caregiver is a no-show or is late by thirty minutes than the client should call the Been There, Inc. office’s phone number. A replacement caregiver will be contacted. If a caregiver misses three visits within a month’s time than they will be terminated, and a grievance should be filed by the client with Been There, Inc. Only Been There, Inc. staff are permitted to perform the caregiver’s duties. Caregivers are not permitted to use friends/relatives to be their replacement if they are not Been There, Inc. employees. If this happens than the client should contact the office as soon as possible. Client’s should call the agency if an additional visit is needed, and the agency will try to obtain authorization for the additional visit.

Hospice Clients:

If a client is receiving Hospice care than their caregiver from Been There, Inc. cannot be there while the Hospice worker is there also. This is known as double dipping, and both agencies can get into trouble with Nevada’s Medicaid. Two different agencies cannot provide services on the same days and times. A Hospice client can receive Personal Care Services from Been There, Inc., but it cannot be on the same days and times when the Hospice worker is there. This is strictly prohibited.
